SSB General Awareness Series: All you need to know about Capital Punishment

Capital Punishment involves execution of a person who has committed a very heinous crime, which falls in the rarest of rare category as specified by the Supreme Court. Voting against the United Nations General Assembly resolution India still hold the right to exercise Capital Punishment.

When is the Capital Punishment Awarded?

According to the Supreme Court any person or group of people who commit(s) the following heinous crimes are punishable by death:
  •    Murder,
  •    Robbery followed by murder,
  •    Plots a conspiracy against the nation,
  •     Abets a child’s suicide,
  •    Rape or gang rape which leaves the victim in a permanently vegetative state,
  •    Honor killings,
  •    Second offence of large scale narcotics trafficking,
  •    Any person who commits sati or anyone who abets the commission of such sati, either directly or indirectly shall be punishable by death.

 Till now 52 people have been claimed to be hanged for their crimes. The hangings have always sparked an outrage by the human rights group. But given the seriousness of the crimes committed by these individuals, hanging them seems the only option. From 2004 to 2012 no hangings were carried out, however, the hangings of the Pakistani trained terrorist Ajmal Kasab who carried out an attack at the Taj Mumbai and Afzal guru who carried out an attack on the parliament broke the silence.

The basic purpose of criminal laws in any country is reformation of the criminals and not their retribution. These laws aim at restoring the faith of the society in the justice system and capital punishment may is a means to do just that.

Capital punishment has been prevalent from the historic times. In the modern era it may be carried out by using poison injections, electrocutions, hanging or shooting but it has always been a source to provide justice and maintain law and order in the society by executing those who have little regard for human life. Today almost 139 countries have abolished capital punishment but countries that still support it either partially or wholly include India, Pakistan, China, Latin America and North America.

Capital punishment may seem a step too barbaric in its means and may seem as a means to take vengeance for the victim’s family against the culprit, but the motto is to send a message to all the criminals out there who have no regard for human life, to people like Surinder Kohli who strangled young girls and then raped their dead bodies, to people like Ajmal Kasab who  are being brainwashed in the name of religion and are trained to kill innocent lives, to people like Afzal Guru who attack the parliament and try to spread terrorism in the country and many more. Sometimes being barbaric in means is the only way to maintain peace.

In my opinion capital punishment should be maintained and should not be abolished. Rape cases like Nirbhaya’s happen with every passing day in the country, most of them go unreported. Criminals have this habit of violating the law as if no body is watching them; they just don’t have any fear in them. Why? The reason is there are loopholes in the justice system as well. People commit crime, the case reaches courts and is tried out for years, and meanwhile another murder or another rape happens. The government needs to act fast on this one. We can’t let these predators roam in the society and put the female members of the society at risk. The recent documentary released for Nirbhaya’s case shows what a rapist thinks about women, what more proof does government need to hang such people?

The recent massacre, which took place in Pakistan by Taliban, made the Pakistani government act unlike the Indian government, which only reacts. Several hangings were carried out in span of days clearly stating that such acts won’t be tolerated, why can’t our government do that? What or who is stopping us? Why can’t the terrorists be hanged instead so that a strong message is sent to the society and to the anti social elements? The Government of India needs to take this matter very seriously; today as the north and eastern states are affected by insurgencies, carrying out capital punishment is the only feasible option to show that we mean business. Its only after the government toughens up, instead of having the cases pending in court rooms for ever make decisions at a faster rate and act more responsibly shall our country be free from such people and the people of the country would feel safe.
